What are Guardianships and Conservatorships?
Guardianships and conservatorships are legal mechanisms that put a legal caretaker in place to manage the affairs of someone who is or who has become unable to protect themselves or unable to make decisions concerning health care or financial decisions due to undue influence of others, by age or health problems. Guardians are appointed to look after minor children.
Conservators and guardians are appointed to handle certain aspects of the person’s or child’s affairs. Conservators of the estate are appointed to manage the person’s financial affairs. Conservators of the person are appointed to ensure the care of the person, such as health care decisions, food, clothing and shelter and where the person will live. A conservatorship is not always needed if other estate planning strategies can be used.
Similar distinctions are made for guardians that are appointed to care for a minor child if the parents have died or are unable to care for the child. Conservators may be appointed for persons with developmental disabilities, and these conservatorships are known as limited conservatorships. Limited conservators will be appointed to handle only the matters dictated in the judge’s order of appointment. Persons with developmental disabilities will retain all other legal and civil rights.
